Is Peru Regressing on Protections of Human Rights?

R. Evan Ellis, Latin America research professor at the U.S. Army War College’s Strategic Studies Institute: “Passed by a Congress tainted by corruption, the new law raises troubling questions. It goes against widely recognized international legal norms, including the 1968 Convention on the Non-Applicability of Statutory Limitations to War Crimes and Crimes Against Humanity, signed by 56 parties, and Article 29 of the Rome Statute establishing the International Criminal Court, which establishes that war crimes cases, among other matters within the court’s jurisdiction, do not have a statute of limitations. According to Peru’s attorney general, the new law stops 600 pending cases, involving 550 victims, raising questions of justice and Peru’s posture on human rights, as also noted by UNHCR High Commissioner Volker Turk. Nonetheless, there is another side. From 1980-2000, 69,000 people were killed, often brutally, in Peru’s war against the Shining Path terrorist group, with 54 percent of these ascribed to the terrorists, according to the 2003 Truth and Reconciliation Commission report.
