Will Fake News Influence Brazil’s Presidential Vote?

Alfredo Attié Jr., justice at the Supreme Court of São Paulo: “As a post-colonial country, Brazil has experienced a difficult relationship with the idea of rule of law. The concept is so abstract and distant from the Brazilian experience that even jurists have great difficulty adapting to it and adopting it. This is one of the reasons our judicial decisions are so contradictory and so influenced by political debate. Courts and institutions have given answers that vary widely in meaning, scope and effectiveness. For example, recently, the electoral court ruled on a very important case concerning the use of false information and illicit influence mechanisms during the last presidential election process. The court acknowledged the illicit use of information, having considered the evidence sufficient, but it dismissed the case on unreasonable—even dubious—grounds, showing exaggerated respect to the president or taking into consideration extra-legal facts and consequences. The main function of social media companies is to provide technological remedies to avoid the use of misinformation. The problem is huge, and I expect it to significantly influence…”
