What Can Mexicans Expect From the New High Court?

  • Constitutional lawyer Hugo Aguilar Ortiz is to be sworn in as the president of Mexico’s Supreme Court on Sept. 1, three months after the country’s first-ever judicial elections, which saw voters select a new slate of justices—that included three incumbents—to the nine-seat high court. Aguilar told Bloomberg News in early July that he will work to ensure companies pay their fair share of taxes. What are the biggest business-related decisions that are likely to be up before Mexico’s Supreme Court in the coming months? What impact will the high court have on issues such as tax collection and business regulation in Mexico? To what extent might the rulings of the new Supreme Court be different from those of previous high courts?

María Calderón, senior program associate in the Mexico Program at the Inter-American Dialogue: “The newly constituted Supreme Court in Mexico is expected to handle several high-impact cases with serious implications for the business climate. One of the most consequential is the ongoing tax litigation involving Grupo Salinas, particularly its billionaire owner Ricardo Salinas Pliego, whose companies reportedly owe nearly 70 billion pesos (more than $4.3 billion) in unpaid taxes. The dispute centers on value-added tax misreporting, capital gains and intercompany transfers. The outcome will test the court’s willingness to back strong federal enforcement and could set a precedent for future large-scale tax disputes. The court’s role in tax collection and business regulation will likely expand under this new composition.
