First, some Latin American countries have intensified their anti-corruption efforts, and U.S. businesses may face increased scrutiny if they resort to bribery. Second, despite the pause in FCPA enforcement, U.S. companies remain subject to other laws, including securities laws and anti-money-laundering regulations. The Foreign Extortion Prevention Act, another tool against foreign corruption that criminalizes the receipt of bribes by foreign officials, remains enforceable. U.S. prosecutors could still pursue companies under theories of aiding and abetting or…”
